Here’s a new type of case that I’ve never heard of before. LiveUniverse is getting sued for having lyrics on their website. Apparently lyrics are copyrighted too.
The organizations behind the lawsuit include the National Music Publishers Association, Peermusic, Warner/Chappell, and Bug Music.
“These sites are profiting on the backs of songwriters. It is unfortunate that copyright holders must so frequently divert energies to protect their rights to license and distribute their works,” stated NMPA President and CEO David Israelite. “However, the demand for music prompts a seemingly endless stream of illegal business models.”
These music organizations are also suing Motive Force LLC, a company that hosts a wiki website called LyricWiki that has over 1 million pages of lyrics. Pennsylvania resident Sean Colombo started Motive Force.
MySpace co-founders Brad Greenspan started LiveUniverse shortly after News Corporation bought out the major social network.
Electronic Arts Inc. (NASDAQ:ERTS) is almost done launching the Madden franchise on the iPhone. The first Madden game for the iPhone will be released in September. Madden NFL 10 on the iPhone will have 32 licensed teams and their real stadiums.
The game accounts for Michael Vick being in an Eagles uniform and Brett Favre will be on the Minnesota Vikings. Some of the features in the game include Action Control Time and Season Mode.
You can play the game through the whole season, complete with trades and acquisitions. The game will also have full stats, individual player rewards, depth charts, free agent pools. etc.
Columbia Pictures is making a movie based on the life of Mark Zuckerberg. The movie is called “The Social Network.” Aaron Sorkin wrote the screenplay for A Few Good Men and wrote the TV show The West Wing.
The Social Network movie is based on the book The Accidental Billionaires by Ben Mezrich. David Fincher, the Director of Fight Club will be directing The Social Network. Supposedly the script of the movie is actually really good in case some of you out there are worried about whether the movie will actually be worth watching.
Even though the movie is based on Zuckerberg’s life, the Facebook CEO never gave his input. As a matter of fact, none of the Facebook employees were allowed to give any input to the movie makers.
Dennis Mudd has stepped down as the CEO of Slacker over the weekend. However Mudd will remain on the B.O.D. Mudd stepped down so he could spend more time with his family. His daily tasks will be passed on to Jim Cady, the current COO and President of Slacker.
Mudd previously founded Musicmatch Jukebox, a company that Yahoo! bought for $160 million in 2004. Slacker raised $70 million in VC funding since the company started. Investors in Slacker include Austin Ventures, Mission Ventures, Rho Ventures, Centennial Ventures, and Sevin Rosen Funds.
Slacker designs a portable music player device. Slacker has BlackBerry and iPhone applications but they have quite a bit of competition.
Apple Inc. (NASDAQ:AAPL) is expected to sell about 5 million units of Mac OS X Snow Leopard, which will be available for download and purchase this Friday August 28. This figure was estimated by consulting firm Piper Jaffray.
Jaffray estimates that about 40 million people have Mac OS X and 5 million unit sales will add $66 million to Apple’s operating income in the third quarter. Piper Jaffray wrote these figures in a note entitled Snow Leopard’s Impact Baked Into Street Ests; Aggressive Competition Vs Windows.
“This equates to as much as $0.05 in EPS impact in the quarter, assuming a 30% tax rate, but we believe the Street has largely factored this into its $1.37 EPS estimate for the Sept. quarter,” stated the note.
Amazon.com founder and CEO Jeff Bezos, Xconomy, and Mass High Tech has invested $7 million into Heartland Robotics. Heartland is a robotics company that is currently in stealth-mode and is based in Cambridge, Mass.
Heartland describes themselves as “combining the power of computers — embodied in robots — and the extraordinary intelligence of the American workforce, to increase productivity and revitalize manufacturing.” The company will be unveiling their products in the next several months.
One of the reasons why Bezos himself may be interested in robotics is because of the way that Amazon.com utilizes robotics within their distribution and fulfillment centers. Zappos.com, a company that Amazon.com recently acquired has a massive distribution center in Louisville, Kentucky.
One of the co-founders in Heartland includes Rodney Brooks. Brooks is a professor in robotics at M.I.T. and also previously founded iRobot.
PubMatic is an advertising management startup company that raised about $7 million so far. The company provides real-time ad optimization analytics to help companies increase revenue.
Andrew Rutledge worked for DoubleClick, but became a Google executive after the acquisition. Now Rutledge will be working at PubMatic in the same position. Josh Wetzel, former head of business development for eBay’s Shopping.com will also be joining PubMatic.
PubMatic’s investors include Draper Fisher Jurvetson, Nexus India Capital, and Helion Ventures. PubMatic currently has about 5,500 web publishers that they work with for ad optimization.
Research In Motion, the company behind all of the BlackBerry devices has acquired Torch Mobile.
Torch Mobile is best known for designing applications based on WebKit. Torch plans to apply their knowledge with WebKit on Research In Motion’s mobile devices.
WebKit is web rendering software that is used on Google Android, Google Chrome, Apple Safari, Palm WebOS, etc. BlackBerry devices are good at e-mail, but lack a solid browser. However rumor has it that Research In Motion wants to get Adobe Flash and Microsoft Silverlight running on their browsers.
