Microsoft Attempting To Prevent Apple From Trademarking “App Store”

Microsoft Corporation (NASDAQ:MSFT) is taking action to try and prevent Apple Inc. (NASDAQ:AAPL) from trademarking the term “App Store.” Microsoft is asking the U.S. Patent and Trademark Office to refuse Apple’s registration request because they believe the term is too generic. “Any secondary meaning or fame Apple has in ‘App Store’ is de facto secondary meaning that cannot convert the generic term ‘app store’ into a protectable trademark,” stated a Microsoft lawyer.
The Microsoft filing also notes that the media commonly refers to “app stores” on different mobile platforms. For example, Apple CEO Steve Jobs once referred to the Android Market as an “app store” in an interview. Microsoft and other rivals are being forced to use alternative names for their mobile application stores pending Apple’s trademark.
