According to an order issued on Friday, U.S. District Judge William Pauley III has ruled that Melvin Colon cannot rely on the Fourth Amendment to suppress Facebook evidence that led to his indictment. One of Colon’s Facebook friends was an informant and let the police see Colon’s Facebook photos and messages. It turns out that Colon posted messages about violent acts and threats to rival gang members. The government has used the information to get a search warrant for Colon’s Facebook account.
