Judge Lucy Koh Just Asked Apple’s Lawyers If They Are “Smoking Crack”

U.S. District Judge Lucy Koh of the U.S. District Court for the Northern District of California is overseeing the patent lawsuits between Samsung and Apple.  She has overseen around 19 nationwide litigations between Apple and associated patents.  Judge Koh recently received a 75-page briefing from Apple that has covered 22 potential rebuttal witnesses that the company might want to call after Samsung is done presenting their case.

When the jury was out of the courtroom, Koh had told Apple’s lawyers “when unless you’re smoking crack you know these witnesses aren’t going to be called!”  Apple’s attorney William Lee said “First, your honor, I’m not smoking crack.  I can promise that.”  However Apple agreed to pare down the document and said that the company did not mean to burden the court.

Koh grew frustrated with Apple after they brought in designer Susan Kare for a round of rebuttal testimony.  However Kare would not be able to attend court until Monday due to family matters.  After a round of discussions, Koh refused and said that Kare could either testify this week or would not return to the courtroom.
