Apple Inc. (AAPL) Wins iPhone Trademark In Brazil

Apple Inc. (NASDAQ:AAPL) now has the right to use the name “iPhone” in Brazil.  This ends a six-year legal battle Apple has been dealing with in Brazil.  A court in Brazil has ruled that a consumer electronics firm called Gradiente must share the “iphone” trademark with Apple.

Gradiente started selling a device called the “iphone” that runs on Android last year.  Judge Eduardo de Brito Fernandes said that Apple’s iPhone product is “world renowned” and said that giving Gradiente the exclusive rights would be unfair.

Gradiente requested the trademark in 2000 through Brazil’s intellectual property office.  Apple was rejected from getting the trademark in 2007.  IGB Electronica is going to appeal the court’s decision.
