50 Cent wins lawsuit against WorldStarHipHop
Rapper, actor, and entrepreneur 50 Cent has won a lawsuit against WorldStar. He filed the lawsuit against the hip hop themed website in 2009. WorldStarHipHop.com apparently used 50 Cent’s image on the header of its website without his permission.
50 Cent argued that the picture gave visitors of WorldStar the impression that the rapper was affiliated with the website or owned it. A judge ruled that 50 Cent would be given “summary judgment on copyright and right of publicity claims.” The judge also rejected defenses of fair use of the image.
“Defendants provide no authority to support the fair use of a celebrity’s image or likeness. This is not surprising, as a celebrity’s image, standing alone, only evokes that celebrity’s persona. [Curtis ’50 Cent’] Jackson’s image does not, by itself, describe anything about Defendants’ website,” said a quote in the ruling.
