<p>Last year a man named Brian Hogan found a prototype iPhone 4 in a bar and <a href="http://gizmodo.com/5520164/this-is-apples-next-iphone">sold it</a> to tech news site Gizmodo. <a href="http://news.cnet.com/8301-31001_3-20090675-261/prosecutors-file-charges-in-prototype-iphone-case/">CNET</a> reports that Steve Wagstaffe, San Mateo County District Attorney, has just announced that Hogan will be charged for theft and that another man named Sage Robert Wallower is being charged as well. Gizmodo, its staff and its parent company Gawker Media are not being charged in any way. <p>The HTC Status, an Android 2.3 phone, is a &#8220;Facebook phone.&#8221; It looks much like your average smartphone. It has a QWERTY keyboard and a 480 x 320 touchscreen, and has both a standard camera and a front-facing camera. But there&#8217;s one little difference: a Facebook button at the bottom, right where your Facebook-loving thumbs can find it. <a href="http://gizmodo.com/5821278/lets-just-pretend-this-isnt-the-facebook-phone">Gizmodo&#8217;s review</a> says, &#8220;I found myself posting and updating and chatting more just because it was so easy to do so.&#8221;</p>

<p>The Facebook button functions differently depending on what you&#8217;re doing with the phone: when you&#8217;re on a webpage, pushing the button offers you the option to share the link on Facebook; when you&#8217;re on your homepage, the button opens up a blank status update ready and waiting for your input. It apparently does location updates when you hold the Facebook button down.</p>
<p><a href="http://gizmodo.com/5821278/lets-just-pretend-this-isnt-the-facebook-phone">Gizmodo criticizes</a> the phone&#8217;s unusual display, which is too small and isn&#8217;t standard enough to work with many Android apps. However, they do recommend buying it as an inexpensive Android phone that just happens to have some Facebook shortcuts.</p>

The U.S. Marshals Service said that images from federal agencies would not be stored.  It turns out that 35,000 images from a scanner at a security checkpoint at a courthouse in Florida has been saved.  And hundreds of those images have been leaked by Gizmodo.<br />

Gizmodo received and shared the images through the Freedom of Information Act.  The images were taken using millimeter wave scanners that was manufactured by Brijot Imaging Systems Inc.  Images produced resemble &#8220;blurry negatives&#8221; with a &#8220;humanoid form.&#8221; </p>

We understand that it will be controversial to release these photographs. But identifying features have been eliminated. And fortunately for those who walked through the scanner in Florida last year, this mismanaged machine used the less embarrassing imaging technique.</p>
<p>Yet the leaking of these photographs demonstrates the security limitations of not just this particular machine, but millimeter wave and x-ray backscatter body scanners operated by federal employees in our courthouses and by TSA officers in airports across the country. That we can see these images today almost guarantees that others will be seeing similar images in the future. If you&#8217;re lucky, it might even be a picture of you or your family.

An unreleased Motorola Droid Shadow mobile phone was left in a gym and a picture was sent over to Gizmodo.  This is the second major photo of a device found in a public place sent to Gizmodo within the last couple months, the first being the 4G iPhone.<br />

The phone was left at a corporate Verizon gym in Washington.  Motorola&#8217;s second Droid will be exclusively available on Verizon and has an 8 megapixel camera.  The camera is capable of shooting 720p video.  It also has a 4.3&#8243; screen and will be using Android Froyo.  The Motorola Droid Shadow will have 16GB of internal storage, run on the Snapdragon processor, and have an HDMI port. Here&#8217;s a breakdown of what happened at Gizmodo within the last month.<br />
1. Apple engineer Gray Powell left iPhone prototype at the bar on his 27th birthday night.<br />
2. Drunk guy tells another anonymous guy that he left his iPhone behind and gave it to him.<br />
3. Anonymous guy takes the phone home and turns on the device, notices errors with the camera.  When anonymous guy tried to turn on the iPhone the next day, it was bricked through MobileMe&#8211;someone killed the iPhone remotely.<br />
4. Anonymous guy opens the iPhone 3GS and inside he finds an iPhone that is supposed to be released in the future.<br />
5. Anonymous guy attempted to call Apple HQ and return the device, but kept getting blown off.<br />
6. Gizmodo gets their hands on the device at the cost of $5,000.<br />
7. Gizmodo writes a few posts about the new device (resulting in millions of extra website hits), then sends the device back to Apple.<br />
8. Police raid the home of Gizmodo editor Jason Chen.  The police took his computers, two servers, an iPad, an iPhone, hard drives, and several other devices.</p>
<p>Was the device confiscation legal?  That question can be answered if &#8220;bloggers&#8221; can be considered &#8220;journalists&#8221; according to the law<br />

Gawker Media, parent company of Gizmodo stated that the search warrant on Chen&#8217;s home is invalid due to section 1524(g) of the California Penal Code which states &#8220;No warrant shall issue for any item or items described in Section 1070 of the Evidence Code.&#8221;  Section 1070 of the Evidence Code states that there is limitations on the seizure of property that belong to <strong>journalists</strong> if the property is related to news gathering activities.</p>
<p>&#8220;Are bloggers journalists? I guess we&#8217;ll find out,&#8221; said Gawker founder Nick Denton.  </p>

However Denton admitted that breaking the news about the new iPhone did not make him any extra money.  To buy the iPhone from the thief, Gawker paid $5,000.  On top of that there was $7,000 in extra bandwidth for the servers.  Chen and Diaz will most likely be paid for traffic bonuses too.  And lastly are &#8220;whatever legal bills we end up paying,&#8221; said Denton. Gray Powell, a graduate from North Carolina State University and an Apple Software Engineer was out celebrating his birthday at an establishment called The Gourmet Haus Staudt in Redwood City, California.  Powell&#8217;s responsibilities are to work on the iPhone Baseband Software, which allows the iPhone to make phone calls.  On March 18, 2010 the night of his 27th birthday he was at the Redwood City bar celebrating.  He was celebrating and even wrote a status message from the iPhone he had on him, &#8220;I underestimated how good German beer is.&#8221; The phone that he was using was the new iPhone disguised as an iPhone 3G S.  And he left that iPhone on a bar stool.  Eventually that iPhone found its way into tech blog Gizmodo&#8217;s hands at the cost of $5,000 from someone that found it.<br />

The person that sold the lost iPhone to Gizmodo tried playing with the phone he found, but it kept crashing.  When he pulled up the Facebook application, Powell&#8217;s profile was loaded, confirming that the device belonged to him.  Apple bricked the phone remotely using MobileMe so the anonymous person actually open the fake 3G S and found another iPhone within the exterior.  Gizmodo reached out to Powell to let him know that they have it and will be giving it back to him. Gizmodo broke the news about the new iPhone and they saw a huge spike in web traffic because of that article.  At least 10 million additional views were generated by them breaking the news. <p>Gizmodo even received a legal letter from Apple asking for the device back.  &#8220;Dear Mr. Lam, It has come to our attention that GIZMODO is currently in possession of a device that belongs to Apple.  This letter constitutes a formal request that you return the device to Apple.  Please let me know where to pick up the unit.&#8221;  Signed by Bruce Sewell, SVP and General Counsel of Apple Inc.</p>
<p>Looks like there will be no surprises when the new iPhone is announced.  It appears that Powell deleted any traces of finding him on the Internet now.  His Facebook account is gone, Flickr account is gone, his Twitter account is gone, and so is his LinkedIn profile.  But there are Facebook Pages being created that support Powell for losing the device.  The I&#8217;m With Powell Facebook page says that 159 people like it and the Save Gray Powell page currently says 11 people like it [<a href="http://www.facebook.com/#!/search/?post_form_id=93fa920ccf4b52d28c2789a14c273976&#038;q=gray%20powell&#038;init=quick&#038;ref=search_loaded">Facebook search on Gray Powell</a>].</p>

A few days ago, Gizmodo blogger Adam Frucci wrote a post called the Seven Types of Employees You Meet at Best Buy.  The seven types of employees include car audio thug, marginally cute customer service girl, grizzled old home theater/computer sales lifer, pervy Geek Squad guy, sad department manager, slick careerist manager, and terrifying loss-prevention guy.  This blog post got the attention of some of Best Buy&#8217;s top brass because the Best Buy CMO Barry Judge retaliated to the blog post.</strong></p>
<p>Below is an excerpt from<a href="http://barryjudge.com/the-one-type-of-gizmodo-blogger"> Judge&#8217;s blog</a>:<br />
&#8220;We couldn’t resist taking a stab at classifying the seven types of Gizmodo bloggers, but then we realized there’s really only one type of Gizmodo blogger. Here’s that description:</p>
<p>You&#8217;ll find this guy on his couch, sporting an ironic t-shirt with a delivery-food stain of some kind. He &#8216;commuted&#8217; minutes earlier by rolling out of bed and over to his laptop in his shoebox-sized Brooklyn (Williamsburg) apartment littered with empty Redbull cans. He came to Gizmodo 9 months ago after deciding that &#8220;traditional media&#8221; wasn&#8217;t edgy enough (read: required pants and didn&#8217;t like it when he powered down walls of TVs). He only puts on pants in order to put electronics down them, and he gets very upset if you mess with his Star Wars legos. He genuinely believes that the hot PR girl is into him and not just trying to get a post. He overuses the word &#8216;fail.&#8217;&#8221;</p>
