Eastman Kodak Company (NYSE:EK) is suing Shutterfly, Inc. (NASDAQ:SFLY) over patent infringement.  Shutterfly is suing Kodak back as a result according to a regulatory filing.  Kodak&#8217;s online photo uploading service Kodak Gallery directly competes with Shutterfly.com.<br />

Kodak Gallery and Shutterfly.com both sell photo books, prints, calendars, and coffee mugs.  Shutterfly received the Kodak lawsuit on Friday, which is seeking an injunction along with costs and damages (legal fees).  The lawsuit does not specify which patents are in dispute.  </p>
<p>In Shutterfly&#8217;s counter-lawsuit, they also are seeking an injunction, damages, and costs. &#8220;(Shutterfly) believes that it has meritorious defenses to this action and intends to defend this matter vigorously,&#8221; stated the company in the filing.</p>

<p>&#8220;So, Kodak, are you serious? I have 3000 photos and now you&#8217;re telling me the only out I have for free is to download them all ONE AT A TIME? This is bush league. I&#8217;d be perfectly content to give your storage back and never give you another penny of my money if you gave me a legitimate option. But now I&#8217;m left to wonder, is this the example you want to set in a world powered by user-generated content? For a company trying hard to reinvent themselves in the digital age? In an environment where you&#8217;re losing market share to newer, nimbler and smarter companies? To be the one to put doubt in customers&#8217; minds about storing things in the &#8220;cloud&#8221;?&#8221; wrote upset Kodak user Matthew Knell <a href="http://www.tagsmith.org/2009/05/28/dear-kodak-stop-holding-my-pictures-hostage/">on his blog</a>.</p>
<p>If you still happen to have pictures on Kodak Gallery, you don&#8217;t have a back up of the pictures, and don&#8217;t want to pay them start saving the pictures as soon as possible.  I remember users weren&#8217;t too happy when Yahoo! Photos shut down too.</p>

Eastman Kodak Company (NYSE:EK) stated today that anyone that does not order $5 per year worth of pictures will see them get deleted from the online Kodak Gallery service.</p>
<p>The company decided to change its terms of service to add that detail today.  People that are storing less than 2GB of photos are required to spend at least $4.99 and those storing over 2GB are expected to spend $19.99 per year.  “Failure to meet this requirement may result in your photos being deleted from the Gallery,” stated Kodak.</p>
<p>People that use the Kodak Gallery can check how many days they have left to make an order within the My Account section of the Kodak Gallery.</p>
