Oracle CEO Larry Ellison is <a href="http://www.techmeme.com/120417/p25#a120417p25">taking the witness stand</a> today in Oracle&#8217;s lawsuit against Google.  Ellison will be examined by Oracle&#8217;s lawyers.  Oracle filed a lawsuit against Google for infringing on their patents and copyrights on Java while working on building the Android operating system.<br />

Ellison&#8217;s testimony will happen after Oracle lawyers make their opening arguments.  Oracle filed the lawsuit against Google in 2010 after claiming that Android was violating seven different Java patents.  Five of those patents were thrown out of court and two were left in court.</p>
<p>Google offered Oracle a share of Android revenue and $2.8 million in damages, but Oracle declined the offer.  Oracle also accused Google of infringing copyrights on Java APIs.</p>
<p>Google denied the infringement claims and will argue that Java APIs cannot be protected by copyright because they are more akin to programming languages.</p>

Oracle co-president Safra Catz will fill in for Epstein, who previously reported to Catz directly. Oracle Corporation (NASDAQ:ORCL) has reportedly hired private investigators to find Hewlett Packard CEO Leo Apotheker.  HP refused a subpoena for Apotheker because they believe Oracle is just trying to harass him.  Oracle CEO Larry Ellison believes that the theft SAP made through Apotheker costed them $4 billion.</p>
<p>SAP had admitted to software theft through a subsidiary by the name of TomorrowNow.  But they believed it costed Oracle tens of millions of dollars rather than billions.  SAP also claims that they shut down the TomorrowNow subsidiary after learning about the theft.</p>
<p>&#8220;The interest in Mr. Apotheker on the part of Mr. Ellison only happened recently, as a result of Leo&#8217;s appointment to run HP,&#8221; stated SAP spokesman Bill Wohl.  &#8220;That recent interest speaks volumes about why it&#8217;s important to them. The question is, does that at all have anything to do with this case?&#8221;</p>
<p>Ellison has been unable to provide evidence about the $4 billion claim thus far.  The evidence is not looking favorable for Oracle right now because attorneys from SAP have been able to produce e-mails from Oracle executives that states that TomorrowNow was not a threat.  Another e-mail was produced that said that Oracle had not lost any large customers to SAP in the two after it the company bought TomorrowNow.</p>

TomorrowNow is a company that was founded in December 1998 by Andrew Nelson and Seth Ravin to provide technical services for Oracle PeopleSoft licensees.  SAP bought out TomorrowNow in January 2005 and then closed the subsidiary in 2008 because of a lawsuit filed by Oracle.  Now that lawsuit is in trial.</p>
<p>Larry Ellison said that SAP stole Oracle software and resold technology at bargain-basement prices.  Ellison also disapproves of Hewlett-Packard hiring Apotheker as their new CEO.  HP&#8217;s hiring of Apotheker may have to do with Oracle hiring former HP CEO Mark Hurd as co-president of the company.  Its like a Silicon Valley soap opera.</p>
<p>&#8220;It has gotten very, very personal. And it&#8217;s not going to stop,&#8221; stated MIT Sloan School of Management lecturer Howard Anderson in an <a href="http://www.reuters.com/article/idUSTRE6A028P20101101">interview with Reuters</a>.</p>

Oracle CEO Larry Ellison has announced a new system that allows enterprises to run their own cloud in a self-contained system.  The new system is known as <a href="http://www.oracle.com/us/products/middleware/exalogic/index.html">Oracle Exalogic</a>.<br />

Oracle Chairman and CEO Larry Ellison announced the new system at the Oracle OpenWorld 2010 event.  Hardware and software is engineered to work together to run all of your applications in the new system.</p>
<p>The Exalogic box features 30 servers with 360 cores along with networking and storage space.  The Exalogic has Oracle&#8217;s virtual machine technology built in and has the two guest operating systems Linux and Solaris.</p>
<p>&#8220;Oracle agrees with Amazon.com,&#8221; Ellison said. &#8220;We believe it [the cloud] is a platform—a standards-based application development and execution platform. It includes hardware and software. It is virtual and elastic, and it runs a variety of apps,&#8221; stated Ellison during his keynote.</p>

Oracle Corporation (NASDAQ:ORCL) now has a new Co-President: Mark Hurd.  Mark Hurd is the former CEO of Hewlett-Packard Company (NYSE:HPQ).  Hurd quit HP one month ago after a board investigated him for a personal relationship with contractor Jodie Fisher.  Fisher was a former actress who posed for Playboy in college.<br />

Oracle Corporation CEO Larry Ellison is a personal friend of Hurd&#8217;s and he personally criticized HP&#8217;s board in an e-mail to The New York Times.  Ellison went as far as saying that HP&#8217;s reaction was “the worst personnel decision since the idiots on the Apple board fired Steve Jobs many years ago.”</p>
<p>“Mark did a brilliant job at H.P., and I expect he’ll do even better at Oracle,” stated Ellison. “There is no executive in the I.T. world with more relevant experience than Mark.”  Other co-presidents at Oracle included Charles E. Phillips Jr. and Safra A. Catz.  Phillips recently quit the board to make room for Hurd.  Phillips asked to leave Oracle in December.</p>
<p>Hurd admitted to his affair after the woman he had been seeing put up a website and billboards that detailed everything that was going on.  HP and Oracle have been partners for a long time, which helped strengthen Ellison and Hurd&#8217;s friendship.  HP sells computer servers and storage systems with Oracle databases to many of their customers.</p>
<p>When Hurd was working at HP, he helped the company move past IBM as the largest technology company and showed some very consistent financial results.  </p>

Yesterday Oracle sent out a press release stating that Google is infringing on their copyrights and patents that are related to Java.  As you may remember, Oracle acquired Sun Microsystems this past year.  The statement Oracle sent out stated that Google &#8220;knowingly, directly and repeatedly infringed Oracle&#8217;s Java-related intellectual property.&#8221;</p>
<p>In the complaint that was sent to the U.S. District Court for the Northern District of California, it says that &#8220;Android (including without limitation the Dalvik VM and the Android software development kit) and devices that operate Android infringe one or more claims of each of United States Patents Nos. 6,125,447; 6,192,476; 5,966,702; 7,426,720; RE38,104; 6,910,205; and 6,061,520.&#8221;</p>
<p>The way that Google implemented Java in their operating system was a different standard than what is advocated by the standards group.  Oracle believes that Java is a mobile operating system competitor of Google Android.  And Google is using Java technology that is not properly licensed.  Google also hired former Sun Java engineers.  Before becoming the CEO of Google, Eric Schmidt led the team that made Java at Sun.  After that Schmidt became the CEO of Novell.</p>
<p>It will be interesting to see whether the two companies settle out of court.  If it doesn&#8217;t, then things could get really ugly between both companies.</p>
