The FCC is considering changes that would <a href="http://www.techmeme.com/120523/p21#a120523p21">benefit cord-cutters</a>, people that decided that connecting their laptops and using services like Netflix and Hulu makes satisfies them enough to not have a cable TV account with Comcast, AT&#038;T, etc.  The FCC is considering changing the definition of  “multichannel video programming distributor” (MVPD) to include websites like Netflix, Hulu, or YouTube.  MVPDs have always been clearly defined as content providers like satellite and cable companies.  Networks are required to sell their content to any MVPD that wants it.  If the FCC includes YouTube, Hulu, and Netflix as an MVPD, these websites could purchase content from networks like CBS and the network would be forced to sell.  CBS is one out of a few networks that has refused to put their content on Hulu.<br />

The question about who is considered an MVPD came up when Christian online-based media company Sky Angel approached the Discovery Channel to have some of their content offered to Sky Angel customers.  Discovery Channel refused to sell so Sky Angel appealed to the FCC.  Initially the FCC ruled that Sky Angel is not considered an MVPD so Discovery was not obligated to sell.  Sky Angel appealed so the FCC started to consider what an MVPD is today&#8217;s digital world is.</p>

This would be the first time that Google would be taking equity stake in a YouTube content provider according to AllThingsD.<br />

On Wednesday night, YouTube hosted a huge event to inform advertisers that they are spending $100 million for their new &#8220;channels&#8221; as a way of bringing in premium content.  Jay-Z, FloRida, Jennifer Beals, the Neon Trees, and Eric Schmidt were in attendance at the event.  YouTube also announced that they will be <a href="http://www.techmeme.com/120503/p20#a120503p20">spending $200 million</a> on campaign across Google&#8217;s Content Network to push the channels.<br />

&#8220;We will fish where the fish are in a mighty big pond,&#8221; stated Google VP of content Robert Kyncl. &#8220;If you want to lead, join us now for the next seven years. We can build audiences together. We can build brands together.&#8221;</p>
<p>YouTube will eventually train visitors to think of YouTube as an entertainment destination with a programmable channel guide to make finding premium content easier.  &#8220;We learned from TV,&#8221; added Kyncl said. &#8220;You can press a button and relax.</p>

Google Inc. has been pushing the Google+ social network as much as possible.  New Google users are automatically given a Google+ account and there are G+ buttons next to every search result. Megaupload was <a href="http://www.techmeme.com/120412/p22#a120412p22">planning to retain</a> the services of Andrew Schapiro, the legendary lawyer that led YouTube to a summary judgment in their copyright trial against Viacom according to <a href="http://torrentfreak.com/">TorrentFreak.com</a>.  The U.S. government has filed documents that object to Schapiro&#8217;s law firm working with Megaupload.  They cited conflicts of interest that involved Google, Disney, Fox, and YouTube.<br />

After Megaupload was raided in Janaury, the government seized millions of dollars and assets like expensive vehicles purchased by the company executives.  Law firm Sidley Austin LLP negotiated on Megaupload&#8217;s behalf for the return of their assets that were being held in Hong Kong, New Zealand, and Canada.  Additional funds were released to pay Megaupload employees and for Kim Dotcom&#8217;s living expenses.</p>
<p>Quinn Emanuel Urguhart &#038; Sullivan replaced Sidley Austin after they withdrew from the case.  Schapiro is a partner at Quinn Emanuel.  The U.S. government believes that Schapiro&#8217;s past record in copyright cases are a conflict of interest.</p>
<p>The first conflict of interest claims Schapiro&#8217;s involvement in the YouTube case against Viacom.  YouTube is listed as the victim and as a witness in the criminal indictment against Megaupload.  Emanuel cannot have an interest in both cases said the U.S. government.</p>
<p>Another conflict of interest is that Google will be called as a witness in the Megaupload case.  Google had withdrew their AdSense services from Megaupload due to copyright infringement concerns.</p>
<p>“It is unclear how Quinn Emanuel intends to zealously represent defendants Megaupload Limited and Kim Dotcom while also protecting confidential attorney-client information gained in the course of representing other clients [...] particularly where those clients’ interests are directly opposed to those of the defendants,” said the U.S. government.</p>

Back in 2010 a district court threw out Viacom&#8217;s $1 billion lawsuit against YouTube because the video website was protected by the Digital Millenium Copyright Act.  Viacom appealed the case based on certain legal theories that would get around the DMCA safe harbors.  However <a href="http://www.techmeme.com/120406/p14#a120406p14">many of their arguments</a> were not as receptive by the court system as they had anticipated.<br />

The court was suggesting that YouTube might be liable for copyright infringement if they had exerted “substantial influence” on the infringing activities of users.  The court sent the case back to the district court to conduct some fact-finding.  The Second Circuit joined the Ninth Circuit in rejecting the theory that YouTube would lose safe harbor protection if it had general awareness of infringement.</p>
<p>&#8220;Similarly, Viacom tried to import the common law &#8216;vicarious liability&#8217; standard into the DMCA by an aggressive reading of a DMCA exception to the safe harbor where the ISP has the right and ability to control infringing activity.  On that theory, any service provider who could block access to particular materials could lose the safe harbor protections. As the court recognized, that theory doesn’t make sense: the notice and takedown provisions specifically contemplate such blocking where there is notice of infringement – if Viacom were right, the safe harbors would hardly be &#8216;safe,&#8217;&#8221; wrote Corynne McSherry on the EFF blog.</p>
<p>The court even rejected Viacom&#8217;s claim that YouTube was &#8220;willfully blind&#8221; to infringement because they failed to monitor for it.  Service providers do not have a duty to monitor and Viacom does not even qualify as a service provider under the DMCA because it is more like a storage locker.</p>

Just when you thought Viacom&#8217;s $1 billion lawsuit against YouTube was over, the U.S. Circuit Court of Appeals in Manhattan <a href="http://www.techmeme.com/120405/p19#a120405p19">has ruled</a> that YouTube will need to defend themselves from the lawsuit by Viacom in court.  Viacom filed the $1 billion lawsuit against YouTube in 2007.  Viacom said that YouTube was responsible for a huge amount of copyrighted material uploaded by YouTube users.<br />

Back in 2010, a lower court ruled that YouTube was protected from liability for what their users do because of the Digital Millenium Copyright Act.  Under the DMCA, YouTube was responsible for removing offending videos when they were notified by copyright holders.</p>

A reasonable jury could find that YouTube had actual knowledge or awareness of specific infringing activity on its website,&#8221; a two-judge panel said in a 39-page decision.

The Disney Channel and YouTube&#8217;s content deal has started.  This means that there are now 70 episodes from various Disney Channel shows available <a href="http://www.youtube.com/user/disneysshows/videos">for free on YouTube</a>.  Some of the shows currently available include The Emperor&#8217;s New School, The Proud Family, That&#8217;s So Raven and the Suite Life of Zach and Cody.  It is great that YouTube is now starting to offer premium content, but they have a serious user interface problem.  Hulu and Netflix have a much cleaner interface when it comes to individual episodes.
