Microsoft Corporation (NASDAQ:MSFT) has filed a lawsuit against the U.S. Customs and Border Protection for allegedly having secret meetings with Google. The Customs Department reportedly allowed Google to import smartphones made by Motorola Mobility that should have been blocked, according to Bloomberg.
Last year in May, the U.S. International Trade Commission banned Motorola Mobility phones after deciding that they infringed a Microsoft patent for synchronizing calendar events.
?Customs has a clear responsibility to carry out ITC decisions, which are reached after a full trial and rigorous legal review. Here Customs repeatedly ignored its obligation and did so based on secret discussions,? stated Microsoft Corporate Vice President and Deputy General Counsel David Howard. This case is separate from a ban that affected the Galaxy Nexus phone in July 2012, which was overseen in a court battle with Apple.
The ITC ordered the ban on the phones to be in effect until Microsoft’s patent expires in April 2018. An appeal is expected to be heard on August 6th in Washington.
