Pinterest has filed a lawsuit against a Pintrips. Pintrips is a personal travel planning startup that has been accused of trademark infringement, unfair competition, trademark dilution, and false designation of origin. This news comes on the heels that Pinterest won a $7.2 million case and injunction against “cybersquatter” known as Qian Jin. Jin registered over 100 names that sound just like Pinterest and even tried to file for a trademark for the term in China. Jin was also know for trying to pull the same scam by filing trademarks that sound just like Quora. Pinterest also filed a lawsuit against Path over their logo design.
Pinterest and Pintrips are very different in terms of their business models. Pintrips runs a collaborative trip-planning dashboard for tracking flights and prices across destinations in real-time, according to TechCrunch. Pintrips can monitor flight price changes by placing a “pin” button on the flight offers.” Some of the flights that support Pintrips includes American Airlines, Delta, JetBlue, Southwest, United, Virgin America, and U.S. Air. Pinterest focuses on link sharing in the form of virtual pin-boards. ?This action arises from Pintrips? decision to adopt a social media brand that is confusingly similar to Pinterest?s, and its refusal to recognize, discuss or remediate the confusion it causes among consumers,? stated Pinterest’s lawyers regarding the lawsuit.
?When Pintrips launched its own social media service, it could have adopted any number of trademarks. Instead it chose PINTRIPS, which is similar in appearance, sound, and commercial impression to PINTEREST,? added Pinterest in the complaint. ?In doing so, Pintrips has chosen a brand that causes confusion among consumer and implies a connection, affiliation or sponsorship that does not exist.?
Pinterest users have also posted over 660 million pins in the Pinterest Travel category to data. Many people use Pinterest as a travel planning tool also. Pinterest also believes that the Pintrips Pin button is “confusingly similar” to Pinterest’s Pin button.
