T Mobile US Inc (TMUS) Is Suing AT&T For Using Magenta In Aio Wireless Branding

Posted Aug 30, 2013

T Mobile US Inc (NYSE:TMUS) has filed a lawsuit against AT&T because of their use of the color, magenta.  T-Mobile claims that AT&T deliberately used the color magenta in order to piggy-back T-Mobile’s branding.  The lawsuit was filed at the Southern District of Texas, Houston Division.  Aio Wireless was named as the defendant.

?With full knowledge of T-Mobile?s use of magenta, AT&T?s subsidiary chose ? out of all the colors in the spectrum ? magenta to advertise, market and promote its wireless services in direct competition with T-Mobile. Aio does not use the orange coverage map of its parent company, but instead uses in its stores and on its website a magenta coverage map that is strikingly similar in color to the one used by T-Mobile,? said T-Mobile in a statement.

Aio Wireless’ use of the color is slightly darker than the way that T-Mobile uses the color.  T-Mobile believes that Aio Wireless is trying to get a free ride out of their ‘Uncarrier’ branding.

Aio Wireless said that T-Mobile needs an “art lesson.”  Aio also said that they don’t “do magenta.”
