The U.S. International Trade Commission said that HTC and Nokia should not be found liable for infringing on Apple’s patents. Staff lawyer Erin Joffre disclosed their position on the matter during the ITC trial in Washington earlier this week. Apple is seeking that HTC mobile phones running on the Google Android operating system should be banned along with some of Nokia’s devices.

Apple claims that HTC is violating five of their patents. HTC lawyer Robert Van Nest (Keker & Van Nest) argued that Apple’s patents that relates to signal processing and inter-process communications is based on technology that was developed in the early 1990’s and “were, at best, a very narrow distinction” from the invention of others.
